A Moruya man has escaped going to jail by the narrowest margin after pleading guilty to being involved in a brawl outside a courthouse.
Brent Wellington was charged with affray following the incident with his cousin at the front of Batemans Bay Local Court April this year.
Judge Michael Love told the father of seven including a newborn the Section Five threshold for a jail term had been crossed but he found special circumstances because of his family support, connection to a local rugby league club and his role as a dad.
As a result, he placed the 25-year-old on an Intensive Corrections Order for 12 months.
Wellington was also ordered to undergo anger management training and not consume any alcohol or drugs.
His co-accused Michael McFarlane-Potts had already been sentenced to 12 months behind bars with a non-parole period of 6 months.
