The son of South Coast MP Liza Butler and his lawyer have failed to show up to Batemans Bay Local Court for a mention of his drink driving case.
Brendan Peter Barton is charged with mid range drink driving and cause bodily harm by misconduct in charge of a motor vehicle following an incident in Bawley Point late last year.
Police allege the 29-year-old drove onto the wrong side of Bawley Point Road before hitting another car with four people inside on December 6.
Police have asked Judge Doug Dick for more time to prepare their case against Barton.
Police Prosecutor Cory Ware told the court the case was referred to the Police Collision Review Board and he was still awaiting the outcome.
The case has been adjourned until April 20.
